Omnivision takes export compliance seriously and strictly adheres to all applicable United States export control laws and regulations, including:

The International Traffic in Arms Regulations (ITAR), administered by the U.S. Department of State, Directorate of Defense Trade Controls (DDTC)

The Export Administration Regulations (EAR), administered by the U.S. Department of Commerce, Bureau of Industry and Security (BIS)

The Office of Foreign Assets Control (OFAC) sanctions regulations, administered by the U.S. Department of the Treasury
Our products may be subject to one or more of these regulatory regimes, and it is our legal duty to ensure that they are not exported, transferred, or sold in violation of U.S. law.
Customer Export Compliance Certification
By placing an order with Omnivision, you certify and agree to the following:
1. Export Control Awareness
I understand that certain products offered by Omnivision are subject to U.S. export control laws, including ITAR (22 CFR §§120–130) and EAR (15 CFR §§730–774), and may not be exported or re-exported without prior authorization from the U.S. Government.
2. Prohibited Transfers Without License
I acknowledge that it is unlawful under U.S. law to export, re-export, sell, or otherwise transfer any controlled hardware, software, technical data, or services to any foreign person or foreign entity — whether inside or outside the United States — without first obtaining proper export authorization from the U.S. Department of State or Commerce, as applicable.
3. Definition of Foreign Person
I understand that, as defined in ITAR §120.16, a “foreign person” includes:

Any natural person who is not a U.S. citizen, lawful permanent resident (Green Card holder under 8 U.S.C. §1101(a)(20)), or protected individual under 8 U.S.C. §1324b(a)(3)

Any foreign corporation, business association, partnership, trust, society, or group not incorporated or organized to do business in the U.S.

Any international organization, foreign government, or agency/subdivision thereof (e.g., diplomatic missions)
4. Export Compliance Liability
I understand that I am personally and legally responsible for complying with all applicable U.S. export control laws and regulations. I acknowledge that violations may result in severe criminal and civil penalties, including fines, imprisonment, seizure of goods, and loss of export privileges under statutes such as the Arms Export Control Act (AECA) and the Export Control Reform Act (ECRA).
5. Diversion Prohibited
I agree that any diversion of products obtained from Omnivision contrary to U.S. law is strictly prohibited. I understand that I may not directly or indirectly export, re-export, transfer, or resell any product to:

Any person or entity listed on a U.S. government denied party list

Any country subject to comprehensive U.S. sanctions or embargoes (e.g., Cuba, Iran, North Korea, Syria, Russia, etc.)

Any prohibited end-user or for a prohibited end-use (e.g., development of nuclear, biological, or chemical weapons)
6. Denied and Sanctioned Parties
I certify that:

I am not listed, and no party involved in this transaction is listed, on any of the following:

U.S. Department of Commerce Denied Persons List, Entity List, or Unverified List

U.S. Department of State Debarred Parties List
-
U.S. Department of the Treasury Specially Designated Nationals (SDN) List

I will not export, re-export, or transfer any product for the benefit of any such listed party.

7. Prohibited End-Use
I confirm that no product purchased from Omnivision will be used in the design, development, production, or deployment of:

Nuclear weapons

Chemical or biological weapons

Missile or rocket systems

Unmanned aerial vehicles (UAVs/drones) for military purposes
-
Any other restricted military or weapons of mass destruction (WMD) applications as defined by U.S. export laws
8. Certification of Truthfulness
I affirm that all information I have provided in connection with my order and this agreement is accurate, complete, and truthful, and that I am acting in good faith in compliance with U.S. export control regulations. I understand that knowingly providing false or misleading information may be a violation of federal law.
Domestic Shipping Does Not Equal Exemption
Please note: even if your order ships within the United States, U.S. export control laws still apply. You may not transfer, export, or give access to controlled items to any foreign person or entity — even domestically — without proper authorization (this includes sharing technical data, manuals, or operation instructions).

Enforcement
Omnivision reserves the right to:

Cancel or reject any order that raises export control concerns

Request end-use/user statements
-
Deny shipping to restricted individuals, entities, or destinations

Cooperate fully with U.S. Government investigations or enforcement actions
Acknowledgment
By purchasing from Omnivision, you agree to abide by all applicable U.S. export control laws, and certify that you have read, understood, and agreed to the terms outlined in this Compliance Policy.
